Freight driver loses unfair dismissal case

Date: 26 July 2007

A freight lorry driver in Stafford has lost his claim for compensation for unfair dismissal.

Roger Morris was working for Culina Logistics when he was sacked for refusing to make an extra delivery, RoadTransport.com reports.

Mr Morris maintained that he would have exceeded 15 hours of driving if he had made the extra load delivery, and feared that he may have been breaking the law.

At the Birmingham Employment Tribunal he accused Culina of ignoring health and safety regulations, although the firm denied that the journey from Market Drayton to Stafford would have pushed Mr Morris above the 15 hour level.

The tribunal decided that the logistics firm was acting within the bounds of reasonable behaviour by dismissing him, and his compensation claim was thrown out.

Chilled food and drinks haulier Culina Logistics operates from bases in Market Drayton (Shropshire), Milton Keynes and Prime Point (Staffordshire).

It recently invested in 11 new Volvo lorries that comply with EEC Euro 5 regulations as part of its environmental commitment.
